The terms governing the provision of appliance repair services by Mendwell Appliance Repair. To be read alongside the Warranty, Cancellation, Refund, and Privacy Policies.

1. Introduction

These Terms and Conditions (the “Terms”) govern the provision of appliance repair services by Mendwell Appliance Repair (“Mendwell”, “we”, “us”, or “our”), a business name registered under the laws of the Province of Ontario, to the customer (the “Customer”, “you”, or “your”). By engaging Mendwell to perform Services, the Customer agrees to be bound by these Terms.

2. Definitions

  • Appliance means the residential household appliance presented to Mendwell for service.
  • Diagnostic means the visit, inspection, and written assessment by which Mendwell determines the cause of an Appliance fault.
  • Quote means the written statement of charges provided by Mendwell to the Customer prior to the commencement of any repair work.
  • Service means any repair, replacement, installation adjustment, or maintenance work performed by Mendwell on the Appliance.

4. Booking and Confirmation

4.1 Service requests may be submitted by telephone, electronic mail, or the contact form provided on the Mendwell website.

4.2 Mendwell confirms appointments with an arrival window communicated to the Customer in advance.

4.3 Mendwell reserves the right to decline service requests that fall outside its scope of work, service area, or business hours.

5. Customer Responsibilities

The Customer agrees to:

  • Provide accurate information about the Appliance, including brand, model, and observed symptoms, at the time of booking;
  • Ensure safe and reasonable access to the Appliance and the work area;
  • Disclose any known prior damage, modification, or repair attempt that may bear on the Service;
  • Be present, or arrange for an authorised adult to be present, for the Diagnostic and during the performance of the Service.

6. Diagnostic and Quote

6.1 The Diagnostic fee covers the Mendwell technician’s time to assess the Appliance and produce a written Quote.

6.2 The Diagnostic fee is payable upon completion of the Diagnostic, regardless of whether the Customer elects to proceed with the Service.

6.3 The Quote is provided in writing prior to the commencement of any repair work. The Customer is under no obligation to accept the Quote.

7. Pricing and Changes in Scope

7.1 Pricing for parts and labour is set out in the Quote.

7.2 Quotes are valid for the period stated on the Quote itself.

7.3 If additional faults are discovered during the Service that materially change the scope of work, Mendwell shall halt the work, advise the Customer, and issue a revised written Quote prior to continuing. No additional work shall be performed without the Customer’s prior approval.

8. Payment

Payment for the Diagnostic fee and any completed Service is due on the date of service, unless otherwise agreed in writing. Accepted payment methods are set out on the invoice.

9. Regulated Work

Certain repairs are subject to Canadian federal or Ontario provincial regulation, including but not limited to refrigerant sealed-system work and gas-appliance work. Where the Customer’s repair requires regulated work, Mendwell shall confirm the same at booking and the Quote shall be issued accordingly.

10. Customer-Supplied Parts

Mendwell may decline to install parts supplied by the Customer or a third party. Where Mendwell agrees to install such parts, its Warranty does not extend to those parts, and Mendwell shall not be responsible for their fit, quality, or compatibility with the Appliance.

11. Photographs and Service Records

Mendwell may photograph the Appliance and the Service for the purpose of internal service records. Such records are kept confidential and shall not be published or used for marketing purposes without the Customer’s prior consent.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, Mendwell’s total liability in connection with any Service shall be limited to the amount paid by the Customer for that Service.

12.2 To the maximum extent permitted by law, Mendwell shall not be liable for indirect, incidental, special, or consequential damages of any kind, including but not limited to spoiled food, loss of rental income, business interruption, or property damage not directly caused by the negligence of Mendwell.

12.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

13. Force Majeure

Mendwell shall not be liable for any delay in or failure of performance resulting from events beyond its reasonable control, including without limitation acts of God, severe weather, public emergency declarations, supplier outages, and supply-chain disruption affecting the availability of parts.

14. Privacy

The collection, use, and disclosure of Customer personal information is governed by the Privacy Policy, which is incorporated into these Terms by reference.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Ontario.

16. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with the Warranty, Cancellation, Refund, and Privacy Policies, constitute the entire agreement between Mendwell and the Customer with respect to the Services and supersede all prior agreements, representations, and understandings.

18. Amendments

Mendwell may amend these Terms from time to time. Material amendments shall be reflected on this page together with an updated Effective Date. The Customer’s continued engagement of Mendwell’s Services following the effective date of an amendment constitutes acceptance of the amended Terms.
